No development shall commence until a Community Use Scheme
for the new tennis club hereby approved has been submitted
to and approved in writing by the Local Planning Authority.
No part of the new tennis club should be brought into use
until the approved scheme has been implemented. Those parts
of the approved scheme that are identified as not being
capable of implementation until after occupation shall be
implemented in accordance with the timetable contained
therein and shall continue to be implemented as long as the
tennis club is in use.

No development shall commence unless or until a plan
indicating the extent of the hedgerow removal and full
details of a scheme of mitigation has been submitted to and
approved in writing by the Local Planning Authority. The
approved details shall be fully implemented within 12 months
of the club being brought into use. Any trees or shrubs
removed, dying or becoming severely damaged or becoming
seriously diseased within 5 years of planting shall be
replaced by trees or shrubs of a similar size and species to
those originally required to be planted to the written
satisfaction of the Local Planning Authority.

and in the interests of visual amenity pursuant to Policy
EN8/2 Woodland and Tree Planting of the Bury Unitary

The development hereby approved shall only be carried out in
accordance with the approved Flood Risk Assessment (FRA),
dated February 2010 and the following mitigation measures
detailed within the FRA shall be fully implemented prior to
the development being brought into use:1. Limiting the
surface water run-off generated by the 1 in 2 years return
period critical storm so that it will not exceed the run-off
from the undeveloped site and not increase the risk of
flooding off-site.
2. Identification and provision of safe route(s) into and
out of the site to an appropriate safe haven.
Reason. To prevent flooding by ensuring the satisfactory
storage and disposal of surface water from the site and to
ensure the safe access and egress from the site pursuant to
Policy EN5/1 of the Bury Unitary Development Plan. |

18 |
Prior to the commencement of development a landscape
management plan, including long- term design objectives,
management responsibilities and maintenance schedules for
all landscaped areas, shall be submitted to and approved in
writing by the Local Planning Authority. The scheme shall
include the following elements:
Detail extent and type of new planting including planting
schedule, with a preference for native species.
Details of maintenance regimes.
Details of any new habitat created on site, including
retention pond.
Details of treatment of site boundaries and/or buffers
around water bodies.
The approved landscape management plan shall be carried out
and any subsequent variations shall be agreed in writing by
the Local Planning Authority.
Reason. To ensure the protection of wildlife and supporting
habitat and secure opportunities for the enhancement of the
nature conservation value of the site pursuant to the
following Policies of the Bury Unitary Development Plan:

No development shall commence unless or until a detailed
scheme for foul and surface water drainage, based on
sustainable drainage principles and an assessment of the
hydrological, ecological and hydrogeological context of the
development has been submitted to and approved in writing by
the Local Planning Authority. The scheme shall include:
Details of above ground surface water drainage scheme
including pond, swales in the north western portion of the
site, as outlined in FRA (RPS, Feb 2010), and it's proximity
and connection with Kirklees Brook tributary.
Details of how the scheme shall be maintained and managed
after completion.
The approved scheme shall subsequently be fully implemented
before the development is first brought into use.
Reason. To prevent the increased risk of flooding, to
improve and protect water quality and improve habitat and
amenity pursuant to the following Policies of the Bury
Unitary Development Plan:

EN6/3 - Features of Ecological Value
EN7/4 - Groundwater Protection

) No works shall be carried out to the trees that would
disturb nesting birds between 1st March and 31st August
inclusive in any year unless otherwise agreed in writing
with the Local Planning Authority.
Reason. In order to ensure that no harm is caused to a
Protected Species pursuant to policies EN6 Conservation of
the Natural Environment and EN6/3 Features of Ecological
Value of the Bury Unitary Development Plan and PPS9 -

No development shall commence unless or until a survey has
been conducted to establish the presence of breeding birds
and brown hares. The survey and a programme of mitigation
measures shall be submitted to and approved in writing by
the Local Planning Authority. The approved mitigation
measures shall be fully implemented before the development
hereby approved has been brought into use.
Reason. In order to ensure that no harm is caused to a
Protected Species pursuant to Policies EN6 Conservation of
the Natural Environment and EN6/3 Features of Ecological

No development shall take place unless or until details of
appropriate measures for the protection of the watercourse
have been submitted to and approved in writing by the Local
Planning Authority. The measures shall include a method
statement outlining the measures that are to be undertaken
to protect the watercourse from pollution during the
construction of the development and measures to ensure that
any contaminants that may be present (for example oil,
petrol and diesel spills) do not leach into the watercourse.
The development shall not commence unless and until the all
measures required by the approved scheme have been
implemented in full to the written satisfaction of the Local
Planning Authority. All measures required by the scheme
shall remain in place until the development has been
completed.
Reason: In order to ensure that the adjacent watercourse is
not subjected from any harm as a result of construction
activity pursuant to Policy EN5/1 - New Development and
Flood Risk and Policy EN6/3 - Features of Ecological Value
of the Bury Unitary Development Plan. |

Notwithstanding the details indicated on approved plan
reference 10/188/100/001 submitted by Bryan G Hall, no
development shall commence unless and until full details of
the proposed highway works on Longsight Road and Hazel Hall
Lane, including details of road markings and any signage,
have been submitted to and approved in writing by the Local
Planning Authority. The highway works subsequently approved
shall be implemented to the written satisfaction of the
Local Planning Authority before the development is brought
into use.
Reason. To ensure good highway design in the interests of
highway safety pursuant to Policy EN1/2 - Townscape and
Built Development of the Bury Unitary Development Plan. |

Notwithstanding the details indicated on approved plan
reference 10/188/100/001 submitted by Bryan G Hall, no
development shall commence unless and until full details of
pedestrian facilities on the existing line of Hazel Hall
Lane between a point opposite the proposed site access and
Longsight Road have been submitted to and approved in
writing by the Local Planning Authority. The facilities
subsequently approved shall be implemented to the written
satisfaction of the Local Planning Authority before the
development is brought into use.
Reason. To ensure good highway design in the interests of
highway safety pursuant to Policy EN1/2 - Townscape and
Built Development of the Bury Unitary Development Plan. |

Notwithstanding the details indicated on approved plan
reference 1221-TCI-02, the 4.5m x 215m/120m visibility
splays indicated on approved plan reference 10/188/100/001
submitted by Bryan G Hall, shall be implemented to the
written satisfaction of the Local Planning Authority before
the development is brought into use and subsequently
maintained free of obstruction above the height of 0.6m.
Reason. To ensure the intervisibility of the users of the
site and the adjacent highways in the interests of road
safety pursuant to Policy EN1/2 - Townscape and Built
Development of the Bury Unitary Development Plan. |

Visibility splays measuring 2.4 metres by 40 metres shall be
provided at the junctions of the proposed car park accesses
with Hazel Hall Lane to the written satisfaction of the
Local Planning Authority before the development is brought
into use and shall subsequently be maintained free of

Reason. To ensure the intervisibility of the users of the
site and the adjacent highways in the interests of road
safety pursuant to Policy EN1/2 - Townscape and Built

The car parking indicated on the approved plans shall be
surfaced, demarcated and made available for use to the
written satisfaction of the Local Planning Authority prior
to the development hereby approved being brought into use.

unless and until a Travel Plan Framework has been submitted

The following two Planning Applications relate to the Former
Liberal Club in Summerseat, now it would appear that Summerseat is
now going to be having, not one but two Indian Restaurants in the
near future!!
As you can see from the following newspaper cutting, taken from
the Bury Times 27th August 2009, the renovation of the former
Liberal Club should be finished by the end of the year, and it will
then be opening as an Indian Restaurant. They apparently do not
require planning permission for Change of Use, as it used to serve
food when it was occupied by the Liberal Club. You can see the
details of the second possible Indian Restaurant further down this
page, as the Old Railway Goods Shed is going to be transformed into
an Indian Restaurant!!

Now regarding Planning Application No. 50419, which was an
application to Construct 9 Tennis Courts (6 with Flood Lighting),
New Club House, Associated Car parking Area and Landscaping on Land
Off Summerseat Lane.
I can now inform you that the Application has now been Withdrawn.
On the 11th of October 2005 Planning Application No. 45384, a
similar application was made with the addition of 2 Children's
Courts and Practice Wall. This was to be constructed on Land Off
Hazel Hall Lane, Summerseat, it was a Resubmission of an earlier
application, but this was Refused, and appeal against the decision
was Withdrawn.
Also the Planning Application No 50418, which was an application
to Build 55 Category II Sheltered Flats for the elderly and House
Managers Accommodation, Landscaping and Car Parking, at Holcombe
Brook Tennis Club, Longsight Road, Holcombe Brook, has been
Withdrawn.

There were two planning applications, I will give details of both of these here.

The first planning application submitted to the Bury
Planning Department with regard to this Grade II Listed Building,
was on the 14th of January 2009.
CHANGE OF USE FROM INDUSTRIAL TO RESTAURANT (USE CLASS A3)
Application Number 50794 -
This application was considered and
Approved with Conditions by the
Planning Control Committee on
24th March 2009.

Here is a Brief Summary:
Permission should be granted having regard to the policies and
proposals listed and the reason(s) for granting permissions can be
summarised as follows;-
The proposed development is acceptable in principle and would not
have an adverse impact upon the amenity of the neighbouring
residents. The proposed development would not harm the special
character or historic importance of the listed building or
conservation area and would not be unduly prominent within the
locality, subject to conditional control. The proposed development
would not be detrimental to highway safety.
There are no other material considerations that outweigh this
finding. 
The application documents state that the restaurant would be
'themed' with railway paraphernalia, they also state that the
Platform and the Hand Cranked Jib-Crane are to be kept, these will
be a feature. From looking at the plans you can see that there are
going to be three floors, the ground will accommodate Kitchen and
Diners Area, the first floor will accommodate two staff bedrooms,
toilets and shower room, and the third floor is to be used for
storage.
The proposal is to utilise the existing building without forming
any new openings on the three main elevations, and maintaining as
far as possible the scale of the interior. As a Grade II listed
building, all original features are to be maintained.
The restaurant would be 'themed' with railway paraphernalia.
The building is grade II listed, and the reasons for its
designation are as follows:

It is a survival from the expansionist second phase of
railway development dating to 1847. |

2 - |
It is associated with the local cotton industry, which it and
the railway it adjoins were built to serve. |
|
3 - |
It demonstrates the original flow of traffic transferring
cotton goods from road to rail transport. |

It survives virtually intact and unaltered from its
original structure, dimensions and floor plan. |
|
5 - |
It contains its original raised platform and a rare
working hand-cranked jib crane dating to the mid-nineteenth
century. |
|
The first three reasons outline the buildings importance in
historical terms. It serves as a visible reminder of how the
Lancashire cotton trade used to transport goods, and as such is
worthy of preserving for future generations to appreciate. |
The building survives virtually intact, and the current proposal
does not involve any works to the original structure to change this.
Externally, no additional openings are to be formed.
Internally, only the necessary new accommodation for use as a
restaurant has been introduced, and limited to one end of the
interior. This allows the volume of the building to be appreciated
as far as possible, by greatly increased numbers of the public.
The original raised platform is to be retained as a feature, keeping
the original stone flagged floor, and the crane preserved as an
exhibit.
The proposed finishes have been discussed with Conservation Officer
Mick Nightingale, and the principle has been adopted to clean and
leave exposed as much of the original stonework as possible,
limiting plastered wall surfaces to the elements of new
construction.

Now this second planning application that was submitted by the East Lancashire Railway,
and concerns the crane
currently located in the Summerseat Old Railway Goods Shed, but owned by Bury MBC
(as a condition of the sale of Summerseat Warehouse that took place
in April 2008) to be removed and re-installed in another grade 2
listed building, Castlecroft Warehouse, Bury, the housing of the
Bury Transport Museum, where it would be on permanent operational
display in the original East Lancashire Railway crane mounted
position, to the visiting public.
On the 20th march 2009, a decision was made to Refuse this
planning application for the following reasons:

1) The proposal would result in the loss of a rare,
working hand-cranked crane, which is a significant feature
of the Grade II Listed Building. This will be of severe
detriment of its appearance, character and historic
interest. The proposal therefore conflicts with the
following policies of the Unitary Development Plan:

2) The application and submitted plans contain
insufficient information with regard to the impact of the
proposal upon the structure of the Grade II listed building,
to enable them to be properly assessed. The proposal
therefore conflict with the following policies of the
Unitary Development Plan:

I am so glad to say that we have had a good result with the
Planning Application to remove the Crane from its original position
in this Grade II Listed Building.

This is a cutting from the Bury Times dated 2nd
April 2009, regarding this matter.
Now I myself am pleased that the planning application to remove
the old crane from the building was refused.
The original Wooden Hand Cranked Hoist in question, dates back to
the mid 1800's, and would have been used to unload the cargo
(Possibly Bales of Cotton) from the goods train, and also to load
the goods onto the horse & cart or wagon, the goods were then taken
to the cotton mills located in the village of Summerseat.
This Hoist is still in full working order today.
This hoist along with the old railway goods shed that it is
located in, is a very large part of our Summerseat Heritage, and it
would have really been such a shame if it was allowed to be removed from
it's present location, to be placed in the Castlecroft Warehouse at
Bury, where it would just be another museum piece.
As we know the Old Railway Goods Shed, was just another building
that the Council decided to sell off, we have lost so much of our
Heritage over the years, and surely East Lancs Railway have had
their chance of this building over the past years, yet now they want
to start taking things from the Listed Building to show in the
Museum.
Please do not get me wrong, I agree that this very old crane
should be seen by the public, but surely it is better to be able to
see it in it's original place where it was purposely built, to
unload the cotton from the trains that visited the sidings all those
years ago, and then the crane would load these goods onto the old
carts being pulled by horses, later taken over by the motorised
wagons, and then these goods would have been delivered to the cotton
mills located around the village of Summerseat.
Now it is stated in the planning application for the change of
use of the building, that it is worthy of preserving for future
generations to appreciate.
It is a shame that this listed
building is being turned into an Indian Restaurant, I am sure that the building could have been put
to a better use. Just imagine how it could have been should it have
been in the hands of the ELR, as it would have made a brilliant
small railway museum together with a lovely tea-house area on the
raised platform section.
The building has NOT been approved for residential purposes.
